Some people believe that there should be fixed punishments for each type of crime. Others, however, argue that the circumstances of an individual crime, and the motivation for committing it,should always be taken into account when deciding on the punishment. Discuss both these views and give your own opinion


Answer:

Individuals have several views about set punishments in a certain crime. Although, there are some benefits of fixed punishments. I believe that the crime should be weight equally before a decision is released.

Firstly, it is close to say that most of the time fixed punishments can gradually reduce a crime. It is evident when sudden offences reduce in number after legislation is implemented. For example, in countries like Saudi Arabia murder is considered a major offence, committing such crime will result in cutting the head of the one who is responsible in killing the individual. These circumstances results in fear of the public in ending someones life due to the thought of ending their lives in a very tragic way as pay back to their wrong doing. Secondly, most people will consider before performing such crime when they know that the consequences will put them in a certain scenario that cannot be resolve by money. Moreover, more people are fearless in doing small crimes that can be bail out rather than heavy crimes with punishments.

On the other hand, I would agree that punishments shouldnt be fixed. This is because some people being accused in performing a crime wouldn't have the time to defend theirselves and would be punish without fair amount of time. For instance, if a person is granted to be sentence by death he will no longer benefit to get a parole if he proves his innocence someday, Having fixed punishments will hindrance most criminals in appealing due to limited amount of time given to them . This is because the judge will decide base in the crime committed instead of looking in a different perspective such as other circumstances that acquire during the crime.

In conclusion, both sides can benefit in giving due punishments to those who committs crime. However, my opinion remains that fair trial should be implemented instead of judging base in what is written in the law.
